Wonderwave Internet Privacy Policy
Your privacy is very important to us. We want to make your experience on the Internet as enjoyable and rewarding as possible, and we want you to use the Internet’s vast array of information, tools, and opportunities with complete confidence.
Wonderwave Internet has created this Privacy Policy to demonstrate our firm commitment to privacy and security. This Privacy Policy describes how Wonderwave Internet collects information from users of Wonderwave Internet services (the “Services”), how we use the information we collect and the choices you have concerning the collection and use of such information. Please read this Privacy Policy carefully.
Collection and Use of Information
Members are asked to provide certain information when they sign up for our Services such as name, address, telephone number, billing information (such as a credit card number), and the type of personal computer being used to access the Services. The personal information collected from Members during the registration process is used to manage each Member’s account (such as billing and collections).
Wonderwave Internet may share personal information with select affiliates in order to provide Wonderwave Internet services to our Members. Wonderwave Internet does not share identifying information (like Name and address) with affiliates for their use in delivering product and service offers to Members. Affiliates will not be allowed to use any information provided in serving our customers to be sold, rented, or given to any other company. Affiliates are not allowed to use Wonderwave Internet data for any other purpose other than Wonderwave Internet approved programs designed to better serve Members.
In instances where Wonderwave Internet and an affiliate jointly promote the Services, Wonderwave Internet may provide the affiliate certain personal information, as a result of the joint promotion. In this instance, the information may not be used by the affiliate for any other purpose. Wonderwave Internet may also generate aggregate profiles from information provided during registration (such as the total number, but not the names, of Members).
We use registration information to contact you in a variety of ways. We may send you offers through email, phone or regular mail of Wonderwave Internet products and services or offers on behalf of selected affiliates. If you order products directly from Wonderwave Internet , we will use your information to continue to provide you products that you are interested in. You may exercise your options to not receive any marketing from Wonderwave Internet by emailing us. Customers will still receive administrative emails from Wonderwave Internet.
Online Shopping
At some web sites, you can purchase products and services or register to receive materials, such as a catalog or new product and service updates. In many cases, you may be asked to provide contact information, such as your name, address, email address, phone number, and credit/debit card information. If you complete an order for someone else, such as an online gift order sent directly to a recipient, you may be asked to provide information about the recipient, such as the recipient’s name, address, and phone number. Wonderwave Internet has no control over third-party web sites and their use of any personal information you provide when placing such an order. Please exercise care when doing so.
Special Cases
It is Wonderwave Internet policy not to use or share the personal information in ways unrelated to the ones described above without also providing an opportunity to opt out or otherwise prohibit such unrelated uses. However, Wonderwave Internet may disclose personal information or information regarding use of the Services if, for any reason, in our sole discretion, we believe that it is reasonable to do so, including: to satisfy laws, regulations or other legal requests for such information; to disclose information that is necessary to identify, contact or bring legal action against someone who may be violating our Acceptable Use Policy or other policies; to operate the Services properly; or to protect Wonderwave Internet , our Services, our employees or our Members.
Wonderwave Internet's Commitment to Children's Privacy
Protecting children’s privacy is especially important to us. It is our policy to comply with the Children’s Online Privacy Protection Act of 1998 and other applicable laws. You must be 18 to use the Services. Wonderwave Internet does not attempt to ask or collect information from any person under the age of 18.
Wonderwave Internet may have products and web pages designed especially for younger users under the direct supervision of an adult Member. While we make every effort to ensure that these Services are fun and age-appropriate for a younger audience, we believe that there is no substitute for proper parental supervision. Wonderwave Internet recommends that children ask a parent for permission before sending any personal information anywhere using the Internet.

Wonderwave Internet Damage Waiver
The radio that connects to our network is usually located outdoors on your roof. Almost all of our clients rent this equipment from us. This is not the same as an internal access point that distributes Internet inside of your house. If you are sure that you purchased the radio that connects to our network then you can disregard this notice.
Wonderwave does it's best to maintain and upgrade your equipment periodically to insure the best Internet experience. If your radio fails during normal operation we will repair it at our expense. We have had many problems related to low voltage and surges, particularly during storms in Spring and also during the Summer when the electric company does not keep up with demand caused by air conditioners.
Wonderwave STRONGLY RECOMMENDS that our clients purchase a UPS (Uninteruptable Power Supply) to insure that surges and especially low voltage do not damage our equipment. Surge protectors do nothing to protect you from low voltage. We have a very reasonable 350va UPS available for $60. You can supply your own UPS. We have had good experience with APC or Tripplite.
All of our equipment is protected by UPS. We believe that the price of the UPS is more than made up by the longer life of the protected equipment. You can plug your computer into the same UPS as our radio and protect it from the same hazards.
If you choose not to use a UPS we reserve the right to charge you if, in our opinion, our equipment is damaged by low voltage or lightning surges. Think of the UPS as your insurance policy. If you have a UPS, we will take care of any problems except physical damage.
By signing this document you agree to be responsible for any damage to our equipment resulting from power surges or low voltage.

Wireless Internet (Broadband) Subscriber Agreement

This Agreement between Wonderwave.net, Inc. located at 3204 Hillside Drive, Wonder Lake, IL 60097 (hereinafter called “Wonderwave” and <FName> <LName>, of <Company>, (hereinafter called “Subscriber”) shall be effective on the completion of connection and shall remain in effect for a period of 12 months.
Provision of Services: Wonderwave will provide services on its computing and network systems and also provide the installation of necessary equipment (radio, cable, lightning protection, antennas & standard mounting equipment) to Subscribers in exchange for payment of fees and compliance with terms and conditions of this agreement. Wonderwave’s services are defined as the use, by Subscriber, of computing, telecommunications, USENET newsgroups and information services provided by Wonderwave and access to computing, telecommunications, software, and information services provided by others via the Global Internet.

Payment Policies & Terms: Subscriber shall be billed on their “Expiration Date” of each month in advance. Payment by Subscriber shall be due to Wonderwave within fifteen (15) days from the date of the invoice. A thirty dollar ($30.00) late payment fee shall be assessed on any account not paid within fifteen (15) days of invoice. Accounts remaining unpaid for thirty (30) or more days shall be deemed delinquent. Delinquent accounts shall accrue interest at 1.5% per month on all outstanding principle amounts until paid in full. For any subscriber account that has been placed on suspended service there shall be due a Fifty Dollar ($50.00) reconnection charge to reactivate Subscribers services.
Account termination: Subscriber may terminate this Agreement by submitting a written request for termination (email, fax, or U.S. Mail) to Wonderwave at the address listed in this agreement. Requests received by Wonderwave prior to close of business on the twenty-fifth day of the month shall have a termination date of the first day of the month following the receipt of the termination request. Termination requests received by Wonderwave after the close of business on the twenty-fifth day of the month through the end of that month shall have a termination date of the first day of the second month following the date of receipt. Any Agreement terminated under this provision shall be subject to a termination fee, which shall equal thirty percent (30%), of the remaining monthly fees due under this Agreement from the date of termination to the end of the Agreement term, or the remaining balance of the contract, or which ever is less. In the event of termination under this provision by a Subscriber all amounts remaining due and owing to Wonderwave including aforesaid termination fee, shall be due within thirty (30) days of termination. Accounts not paid within thirty (30) days of termination shall be deemed delinquent. Contracts will be automatically renewed if no notice of termination is received within 30 days.
Additional Fees: In the event that special construction, or additional equipment including but not limited to, longer cable, additional grounding, higher tower or mast hardware, or specialized antennas, an additional fee will be required for said equipment and any additional labor not included in the standard install. Additional labor is billed at $100/hr.
Equipment & Scope of work: All equipment, (radios, antennas & standard mounting equipment), except for equipment purchased and paid for in full by the subscriber, will at all times remain the property of Wonderwave. Subscriber may not sell, transfer, lease encumber or assign all or part of the equipment to any third party. Subscriber shall pay for the full retail cost of, or the repair or replacement of any lost, stolen, unreturned, damaged, sold, transferred, leased encumbered or assigned equipment or part thereof, together with any costs incurred by Wonderwave in obtaining or attempting to obtain possession of any such equipment. On expiration or termination of this Agreement, Subscriber authorizes Wonderwave to retrieve from Subscribers premises equipment for appropriate disposition, that is owned by Wonderwave, Inc.
Non Standard Connections: In the event of an aborted connection due to insufficient line of sight to an access point, Subscriber will receive a report of the connection options available. The report will include optional mounting configurations and their respective costs. Subscriber may at that time choose one of the available options or decline services. If the Subscriber declines services, Subscriber will be refunded all deposits made, less any equipment the Subscriber decides to retain.
Expedited Connections: Expedited connections with four (4) business days or less will incur a Five Hundred Dollar ($500) expedite charge.
Permitting & Landlord Approval: It is the Subscribers responsibility to obtain any required permits or to gain landlord approval for the placement of the antenna on the Subscribers building. Wonderwave may assist you or provide this service for you for an additional charge. landlord consents to the installation, maintenance, and removal of the equipment described herein and required by Subscriber to receive Wonderwave services.

Standard Maintenance: Wonderwave’s connection point ends at the wireless radio or LAN jack on our router. Any trouble beyond our network or equipment is the full responsibility of the Subscriber and their subsequent Network Administrator or vendor. Standard maintenance is limited solely to Wonderwave’s network and backbone connectivity. If your connection ceases to function properly after it has been tested and shown to be working, but Wonderwave’s network is still functioning properly, a technician will be sent to troubleshoot during normal business hours (9 AM - 5 PM. Monday-Friday). If the problem is due to subscriber negligence, or any of those items listed in the “Not Covered by Maintenance Plan or Standard Maintenance Plan” section, standard hourly rates apply.
Maintenance Plan: Subscriber has the option to select a desired response time and associated cost. Maintenance Plans available upon request.
Not Covered by Maintenance Plan or Standard Maintenance Plan: Maintenance, repair or replacement of parts damaged or lost through catastrophe, accident, lightning, neglect, misuse, transportation, theft, fault or negligence of Subscriber or causes external to the wireless system, such as, but not limited to failure of, or faulty electrical power or air conditioning, operator error, or malfunction of Subscribers computer and/or peripheral equipment not installed by Wonderwave, or from any cause related to or other than the intended and ordinary use. Antenna re-aiming due to obstructions such as trees or buildings, or storm related damage. Any re-aiming of antennas, or reconstruction of tower/mast assemblies will be billed to the Subscribers at standard hourly rates.
Warranties: All Wonderwave provided equipment, cables and antennas are covered for a period of no more than 1 year. If any part of the wireless equipment fails due to manufacture defect prior to one year, it will be replaced at no charge pending testing of said equipment.
Use of Material: All content downloaded or uploaded using Wonderwave’s system shall remain the sole responsibility of the Subscriber. The Subscriber assumes all risks associated with material, including, but not limited to, copyright restrictions, trademark restrictions, service mark restrictions, confidentiality limitations, trade secrets, patent restrictions or any other intellectual property tangible or intangible rights associated with the material.
Use of Services: Subscriber is expressly prohibited from reselling any services offered by Wonderwave under this agreement without the prior written consent of Wonderwave. Subscriber is prohibited from hosting any web site dedicated to the sale or dissemination of pornographic materials and/or containing content of a sexually explicit nature. Subscriber understands and agrees that this service may be utilized solely for lawful purposes and the use of this service in connection with or adjunct to any matter or thing which violates and foreign municipal, state, county, or federal state or regulation is expressly prohibited. Subscriber acknowledges that Wonderwave is a commercial entity. Subscriber agrees that its use of the services herein shall not infringe upon the use by other subscribers of Wonderwave or the wireless network. Subscriber is prohibited from sending unsolicited advertising or promotional materials to other Wonderwave or wireless network subscribers. Should Subscriber violate any provision of this section, Wonderwave, Inc. at its sole discretion may immediately suspend services to Subscriber and terminate this agreement. Wonderwave liability for termination of this Agreement under this provision shall be solely limited to a refund to Subscriber of any unearned prepaid service fees. Wonderwave shall not be liable for any incidental or consequential damages as a result of the termination of the Agreement under this provision. Only Business connections are allowed to use servers.
Abuses of Services: Any use of the Wonderwave system that disrupts the normal use of the system for other Wonderwave Subscribers is considered to be abuse of services. The propagation of computer worms or viruses or the use of the network to make unauthorized entry to other computational, information, or communication devices or resources of others is a violation of this agreement. The use of Wonderwave’s services by Subscriber to modify, alter, reverse engineer, decompile disk, or disassemble any proprietary work in whatever form is a violation of this Agreement. The failure of any Subscriber running IPX to use an IP tunneling protocol is a violation of this Agreement. The broadcast of Routing Internet Protocol (RIP) by Subscriber is a violation of this Agreement. Any Subscriber deemed by Wonderwave to be in violation of this section is subject to immediate termination by Wonderwave. Termination under this section shall have no liability other then to refund any unearned prepaid service fees including direct, indirect, incidental or consequential damages. Any business account server causing abuse on the network will terminate this agreement.
Indemnification/Release: Subscriber, its agent, successor and/or assigns expressly agree to indemnify and release Wonderwave, its affiliates, subcontractors, employees, agents, assigns or successors from any liability for any claims, losses, actions, damages, suits, or proceedings arising out of or otherwise related to Subscribers installation of, use of, or termination of Wonderwave’s services hereunder including but not limited to, Subscribers access to content uploaded or downloaded using Wonderwave’s services from any source or to any recipient. Subscriber further releases Wonderwave from any responsibility or liability related to the accuracy, quality for confidentiality of any information available by or through Wonderwave’s systems and/or the wireless network. Subscribers release of Wonderwave includes any actions or inaction by Wonderwave, which amount to negligence. Subscriber further agrees to indemnify and hold harmless Wonderwave Inc. from and against any and all claims actions causes of action, losses, or damages including attorney’s fees which in any way arise from Subscribers installation of, use of, termination of Wonderwave’s services herein.
Disclaimer: Wonderwave assumes no responsibility for the content contained on the Internet or otherwise available through the wireless network. or from any source accessible via Wonderwave, Inc.’s services. Wonderwave discloses and Subscriber acknowledges that there may be content on the Internet or otherwise available through the services provided by Wonderwave which may be offensive to some individuals, which may not be in compliance with local, state or federal laws, rules or regulations, Including, but not limited to pornographic, or otherwise inappropriate or sexually explicit or offensive content. Subscriber acknowledges to Wonderwave that it’s use of Wonderwave’s services to access information, content or other services is at it’s own risk.
Governing Law and Venue: The laws of the State of Illinois shall govern the terms of this Agreement. The parties hereto stipulates and agree that the exclusive venue of all disputes concerning this Agreement shall be McHenry County, Illinois.
Arbitration & Attorneys Fees: The Subscriber and Wonderwave agree that any controversy or claim between them arising out of or relating to this Agreement shall be settled exclusively by arbitration. The arbitration award shall be final and binding on both parties. Judgment upon such arbitration award may be entered in any court having jurisdiction. Subscriber and Wonderwave agree that should either party bring action for enforcement, interpretation or otherwise under this Agreement the prevailing party in such action shall be entitled to its attorney’s fees and costs including those incurred in any appeal.
Entire Agreement: This Agreement constitutes the entire Agreement between the parties and no other representations or statements will be binding upon the parties. If any part of this Agreement is held to be invalid or unenforceable for any reason, the remaining terms and conditions of this Agreement shall remain in full force and effect. WonderWave.net may revise, amend, or modify this Agreement, the Acceptable Use Policy and any other user policies and agreements, at any time and in any manner.

Wonderwave Internet is a Web Hosting Provider. User accounts on our Internet servers are subject to compliance with the terms and conditions set forth below. Under the terms of this agreement, your placement or placement on your behalf of information on Wonderwave Internets' servers is an acknowledgement that you have read and understood this agreement, and that you agree to be bound by the terms and conditions below.
If you do not wish to be bound by these terms and conditions, you should not proceed to place any information of any kind yourself or on your behalf on Wonderwave Internets' servers.
1. User Conduct
Wonderwave Internets services may only be used for lawful purposes. Any use of these services which violates any local, state, federal, or international laws which may apply to Wonderwave Internet, your local jurisdiction, or any jurisdiction that you or your site may be subject to is strictly prohibited.
2. Indemnification
You agree to indemnify, defend, and hold harmless Wonderwave Internet from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting indirectly from your use of the service which damages either you, Wonderwave Internet, or any other party or parties without limitation or exception. This indemnification and hold harmless agreement extends to all issues associated with your account, including but not limited to domain name selection and Web site content.
3. No Warranties
Wonderwave Internet makes no warranties or representations of any kind for the services being offered. The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of title, noninfringement, or implied warranties of merchantability or fitness for a particular purpose. No advice or information given by Wonderwave Internet or its agents or employees shall create a warranty.
Wonderwave Internet provides no warranty that the service will be uninterrupted or error free or that any information, software or other material accessible on the service is free from viruses or other harmful components. Under no circumstances shall Wonderwave Internet be liable for any direct, indirect, special, punitive, or consequential damages that result in any way from your use of or inability to use the service, or for third parties' use of the service to access your Web space, or to access the Internet or any part thereof, or your or any third parties' reliance on or use of information, services, or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance.
If you are dissatisfied with Wonderwave Internet service or any of its terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the service.
You understand that by placing information on Wonderwave Internets' servers that such information becomes available to all Internet users and that Wonderwave Internet has no way of limiting or restricting access to such information or protecting such information from copyright infringement. You assume total responsibility and risk for your use of Wonderwave Internets' servers and the Internet. It is solely your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise provided through Wonderwave Internets or on the Internet generally.
4. Back Up of Data
Your use of the service is at your sole risk. Wonderwave Internet is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Wonderwave Internets servers.
5. Ownership and Database files
Creation of a Web site involves a variety of intellectual property rights issues. From aesthetic design elements to the structure, sequence and organization of database systems, user interfaces and graphics, the rights are ultimately very valuable. For this reason, ownership must be clearly established in the Web development agreement between client and designer, and Wonderwave Internet is excluded from any third party agreement or liability.
The Web site owner should secure ownership of most of these rights through negotiation. Notably, under 17 U.S.C. Section 101 (Copyright Act of 1976), project deliverables can be designated "works for hire" in the Web development agreement.
Wonderwave Internet merely provides the "container and storage" for these files, and expects the designer or designee to manage those files to back up, maintain, and deliver files as requested.
7. No Interference
You agree not to maliciously or intentionally interfere with the proper operation of the system, including but not limited to defeating identification procedures, obtaining access beyond that which you are authorized for, and impairing the availability, reliability, or quality of service for other customers. You further agree not to interfere with the proper operation of other systems reachable through the Internet, including any attempt at unauthorized access. You agree to follow the Acceptable Use Policy of any network or service you connect to.
You agree to adhere to system policies as published online by Wonderwave Internet, including restrictions on services available with each account type, restrictions on certain features, and all other policies designed to protect and enhance the quality and reliability of service at Wonderwave Internet. You agree to abide by any and all future Wonderwave Internet policy decisions.
8. Security
You agree that the security of your account is solely your own responsibility. You further agree that if you believe the security of your account has been compromised in any way, you will notify Wonderwave Internet immediately by telephone at 815-653-7873. You shall be held fully responsible for any misuse or compromise to your account for which Wonderwave Internet is not properly notified. You agree that if any security violations are believed to have occurred in association with your account, Wonderwave Internet has the right to suspend access to the account pending an investigation and resolution. You also agree that Wonderwave Internet has the right to cooperate in any government or legal investigation regarding any aspect of our services, including services sold to you.
9. Payment
You agree to supply appropriate payment for the services received from Wonderwave Internet, in advance of the time period during which such services are provided. You agree that all setup fees are non-refundable once setup is completed. You agree that until and unless you notify Wonderwave Internet of your desire to cancel any or all services 90 days prior to renewal via email, those services will be billed on a recurring basis. You agree that you are prepaying in advance of services rendered. You agree that pro-rated refunds for unused time periods will be not provided in the event of account termination.
10. Prior Agreements
This agreement supersedes any written, electronic, or oral communication you may have had with Wonderwave Interner or any agent or representative thereof, and constitutes the complete and total agreement between the parties.
11. Jurisdiction
This agreement shall be governed by the laws of the State of Illinois, in the county of McHenry.
12. Severability
If any provision of this agreement is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect and said provision shall be reformed only to the extent necessary to make it enforceable.
13. Acknowledgement
By using and continuing to maintain or place information on Wonderwave Internets' servers you are stating and acknowledging that you have read the aforementioned terms and conditions and that you understand such terms and conditions and agree to be bound by them.
Internet Service Agreement
Read This Internet Service Agreement Carefully Before Using Our Internet Services.
1. INTRODUCTION. Wonderwave.net, (Wonderwave.net Internet Inc.) provides its Internet services, as they may exist from time to time (Services), to users who pay a monthly service fee to subscribe to the Services (Members) as well as to those who access some of our Services but do not have accounts (Visitors). By establishing an account or using the Services, you agree to be bound by this Agreement and to use the Services in compliance with this Agreement, our Acceptable Use Policy and other policies.
If you do not agree to the terms and conditions of this Agreement, including any future revisions, you may not use the Services and if you are a current Member, you must terminate your use of the Services under Section 10.
2. SUBSCRIPTION REQUIREMENTS. Members must be at least 18 years old. Local access dial-up numbers may not be available in all areas. You are solely responsible for determining if use of a particular dial-up number will cause you to incur long-distance, toll, or other charges. Wonderwave.net is not responsible for any long-distance, toll or other telecommunications charges you incur. Current prices for Wonderwave.nets Services are posted throughout our website at http://www.Wonderwave.net. These rates may also be obtained by calling (815) 653-7873. Wonderwave.net reserves the right to change prices and institute new fees at any time without prior notice.
3. PAYMENT OBLIGATIONS OF A MEMBER.
(a) Members must (i) provide Wonderwave.net with accurate and complete billing information including legal name, address, telephone number, and credit card/billing information, and (ii) report to Wonderwave.net all changes to this information within thirty (30) days of the change. Members are responsible for any charges to their account.
(b) Members having questions regarding charges to an account, should contact Wonderwave.nets Customer Service Department at (815) 653-7873. All charges are considered valid unless disputed in writing within sixty (60) days of the billing date. Adjustments will not be made for charges that are more than 60 days old.
(c) Charges are billed to Members credit cards or debit cards, as applicable, each month for the basic service and any additional usage or services. Wonderwave.net is not responsible for any charges or expenses (e.g for overdrawn accounts, exceeding credit card limits, etc.) resulting from charges billed by Wonderwave.net.
(d) If paying by check, payments are due within 30 days after the month in which the charges are incurred.
(e) If you pay for Services through a prepayment plan, automatic billing described above shall only apply to the charges not paid for through the prepayment plan.
(f) If you purchase Services through a reseller who in turns pays Wonderwave.net, the reseller must pay all amounts owing for your account. If the reseller fails to pay Wonderwave.net any amounts duewhether or not you have paid the reselleryour account will be subject to suspension or cancellation until you or the reseller has paid all amounts due.
(g) Delinquent accounts may be suspended or canceled at Wonderwave.nets sole discretion; however, charges will continue to accrue until the account is canceled. Wonderwave.net may bill an additional charge to reinstate a suspended account.
4. MEMBERS ACCOUNT, PASSWORD, AND SECURITY. Upon registration, Members receive a username, password, and account designation. You and members of your household or business, if you have purchased a business account, are the only authorized users of your Wonderwave.net account and must comply with this Agreement. You must keep your password confidential so that no one else may access the Services through your account. You must notify Wonderwave.net immediately upon discovering any unauthorized use of your account. Using a personal account for high volume or commercial use (e.g., revenue generation, advertising, etc.) is prohibited. Email accounts exceeding 10MB in size may, at Wonderwave.nets discretion, be transferred to a compressed temporary file or storage. Wonderwave.net may delete the temporary file from the server 60 days after notifying you. Any free Web site exceeding 6MB may be suspended until the Member reduces the disk space usage to 6MB or less or purchases additional megabytes. Any free Web site exceeding 250MB of traffic will be billed for excess traffic. You may establish a commercial or high-volume account by calling (815) 653-7873. Members agree not to use any automatic method to avoid inactivity disconnect or to otherwise maintain a connection unless actively using it. Members agree not to provide any public information services over a dial-up connection. Wonderwave.net may change its POP numbers at any time. Wonderwave.net reserves the right to direct Members to use certain numbers to access the Service or to restrict use of specific access numbers. Usernames, passwords and email addresses are Wonderwave.nets property and Wonderwave.net may alter or replace them at any time.
5. MONITORING THE SERVICES. Wonderwave.net has no obligation to monitor the Services, but may do so and disclose information regarding use of the Services for any reason if Wonderwave.net, in its sole discretion, believes that it is reasonable to do so, including to: satisfy laws, regulations, or governmental or legal requests; operate the Services properly; or protect itself and its Members. Please see our Privacy Policy. Wonderwave.net may immediately remove your material or information from Wonderwave.nets servers, in whole or in part, which Wonderwave.net, in its sole and absolute discretion, determines to infringe anothers property rights or to violate our Acceptable Use Policy.
6. DISCLAIMER OF WARRANTIES and LIMITATION OF LIABILITY. EXCEPT FOR CERTAIN PRODUCTS AND SERVICES SPECIFICALLY IDENTIFIED AS BEING OFFERED BY Wonderwave.net, Wonderwave.net DOES NOT CONTROL ANY MATERIALS, INFORMATION, PRODUCTS, OR SERVICES ON THE INTERNET. THE INTERNET CONTAINS UNEDITED MATERIALS, SOME OF WHICH ARE SEXUALLY EXPLICIT OR MAY BE OFFENSIVE TO YOU. Wonderwave.net HAS NO CONTROL OVER AND ACCEPTS NO RESPONSIBILITY FOR SUCH MATERIALS. YOU ASSUME FULL RESPONSIBILITY AND RISK FOR USE OF THE SERVICES AND THE INTERNET AND ARE SOLELY RESPONSIBLE FOR EVALUATING THE ACCURACY, COMPLETENESS, AND USEFULNESS OF ALL SERVICES, PRODUCTS, AND OTHER INFORMATION, AND THE QUALITY AND MERCHANTABILITY OF ALL MERCHANDISE PROVIDED THROUGH THE SERVICE OR THE INTERNET. Wonderwave.net MAKES NO EXPRESS WARRANTIES AND WAIVES ALL IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY MERCHANDISE, INFORMATION OR SERVICE PROVIDED THROUGH Wonderwave.net OR THE INTERNET GENERALLY. NO ADVICE OR INFORMATION GIVEN BY Wonderwave.net OR ITS REPRESENTATIVES SHALL CREATE A WARRANTY. Wonderwave.net AND ITS EMPLOYEES ARE NOT LIABLE FOR ANY COSTS OR DAMAGES ARISING DIRECTLY OR INDIRECTLY FROM YOUR USE OF THE SERVICES OR THE INTERNET INCLUDING ANY INDIRECT, INCIDENTAL, EXEMPLARY, MULTIPLE, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES. IN ANY EVENT, Wonderwave.nets CUMULATIVE LIABILITY TO ANY MEMBER FOR ANY AND ALL CLAIMS RELATING TO THE USE OF THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF SERVICE FEES PAID DURING A ONE YEAR PERIOD.
7. SOFTWARE LICENSE. Wonderwave.net grants to each Member a limited, nonexclusive, nontransferable and nonassignable license to install and use the Wonderwave.net access software (including software from third-party vendors that Wonderwave.net distributes; in object code format), its associated documentation, and any updates thereto (Licensed Programs) in order to access and utilize the Services. Each Member agrees to use the Licensed Programs solely in conjunction with the Services and for no other purpose. Wonderwave.net may modify the Licensed Programs at any time, for any reason, and without providing notice of such modification to a Member. The Licensed Programs constitute confidential and proprietary information of Wonderwave.net and Wonderwave.nets licensors and embody trade secrets and intellectual property protected under United States copyright laws, other laws, and international treaty provisions. All right, title, and interest in and to the Licensed Program, including associated intellectual property rights, are and shall remain with Wonderwave.net and Wonderwave.nets licensors. Member shall not translate, decompile, reverse engineer, distribute, remarket, or otherwise dispose of the Licensed Programs or any part thereof. You may not download, use, or otherwise export or re-export the Licensed Programs or any underlying information or technology except in full compliance with all United States and other applicable laws and regulations. By installing or downloading the Software, you represent and warrant that you are not located in, under the control of or a national or resident of any country on the U.S. Treasury Departments list of Specially Designated Nationals or the U.S. Commerce Departments Table of Deny Orders. We may provide links on the Web site to other Web sites which are not under our control. In general, any Web site which has an address (or URL) which does not contain Wonderwave.net. These links are provided for convenience only and are not intended as an endorsement by Wonderwave.net of the organization or individual operating the Web site or a warranty of any type regarding the Web site or the information on the Web site. You may provide a hypertext link to our Web site on another Web site, provided that:

9. TERM OF AGREEMENT. Continued use of the Services constitutes acceptance of this Agreement and any future versions. If you are dissatisfied with the Services or any related terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the Services and, if you are a Member, to terminate your account.
10. TERMINATION. You may terminate your account at any time and for any reason by providing notice of intent to terminate to Wonderwave.net by: registered or certified mail, return receipt requested addressed to Wonderwave.net , Accounts-Customer Service, 3204 Hillside Dr., Wonder Lake, IL 60097. Email termination of your basic Internet access account will not be accepted. To terminate Web Hosting and/or Business Services, you must submit your request in writing. Your termination will only be complete upon your receipt of a cancellation confirmation number from Wonderwave.net. Charges to your account will stop accruing the day Wonderwave.net provides you with a cancellation confirmation number. Based on your billing cycle, charges accrued prior to your termination may apply after you receive a cancellation confirmation. Email cancellation requests will not be accepted. Any services paid for in advance, will not be refunded . If your account included space on Wonderwave.nets servers, anything stored on this space will be deleted upon termination. Without prior notice, Wonderwave.net may terminate this Agreement, your password, your account, or your use of the Services, for any reason, including, without limitation, if Wonderwave.net, in its sole discretion, believes you have violated this Agreement, our Acceptable Use Policy, or any of the applicable user policies, or if you fail to pay any charges when due. Wonderwave.net may provide termination notice to you by: email addressed to your email account or by US Mail or courier service to the address you provided for the Services. All notices to you shall be deemed effective on the first (1st) calendar day following the date of electronic mailing or on the fourth (4th) calendar day following the date of any mailing or deposit with a commercial courier service. Sections 3, 4, and 6, of this Agreement shall survive termination of this Agreement.
11. MISCELLANEOUS. This Agreement, the Acceptable Use Policy, the Privacy Policy, and Wonderwave.nets other user policies posted on Wonderwave.net's Web site constitute the entire agreement between you and Wonderwave.net with respect to your use of the Services. Wonderwave.net may revise, amend, or modify this Agreement, the Acceptable Use Policy and any other user policies and agreements, at any time and in any manner. Notice of any revision, amendment, or modification will be posted on Wonderwave.net's Web site (http://www.Wonderwave.net.) and/or on Member's start pages and/or by email and/or in our various publications and mailings to Members.

Acceptable Use Policy
1. Wonderwave.net ’s Acceptable Use Policy (AUP) is intended to help enhance the use of the Internet by preventing unacceptable use. All users of Wonderwave.net ’s Internet services (the Services)those who access some of our Services but do not have accounts (Visitors) as well as those who pay a monthly service fee to subscribe to the Services (Members)must comply with this AUP.
We support the free flow of information and ideas over the Internet and do not actively monitor use of the Services under normal circumstances. Similarly, we do not exercise editorial control over the content of any Web site, electronic mail transmission, newsgroup, or other material created or accessible over or through the Services, except for certain proprietary Web sites. However, in accordance with our Internet Service Agreement, we may remove any materials that, in our sole discretion, may be illegal, may subject us to liability, or which may violate this AUP. Wonderwave.net may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. Your violation of this AUP may result in the suspension or termination of either your access to the Services and/or your Wonderwave.net account or other actions as detailed in Section 3. This AUP should be read in conjunction with our Internet Service Agreement and other policies. VIOLATIONS OF WONDERWAVE.NET'S ACCEPTABLE USE POLICY
The following constitute violations of this AUP:
a. Illegal use. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that, intentionally or unintentionally, violates any applicable local, state, national, or international law, or any rules or regulations promulgated thereunder.
b. Harm to minors. Using the Services to harm, or attempt to harm, minors in any way.
c. Threats. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that threatens or encourages bodily harm or destruction of property.
d. Harassment. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that harasses another.
e. Fraudulent activity. Using the Services to making fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as pyramid schemes, ponzi schemes and chain letters.
f. Forgery or impersonation. Adding, removing, or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation. Using deliberately misleading headers (munging headers) in news postings in order to avoid spam email address collectors is allowed.
g.Unsolicited commercial email/ Unsolicited bulk email. Using the Services to transmit any unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature, are prohibited.
h. Unauthorized access. Using the Services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Wonderwave.net’s or another entitys computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data.
i. Copyright or trademark infringement. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software. Wonderwave.net is registered under the Digital Millenium Copyright Act of 1998.
j. Collection of personal data. Using the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.
k. Reselling the services. Reselling the Services without Wonderwave.net’s authorization.
l. Network disruptions and unfriendly activity. Using the Services for any activity which adversely affects the ability of other people or systems to use Wonderwave.net Services or the Internet. This includes "denial of service" (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, network services, or network equipment is prohibited. It is the Member's responsibility to ensure that their network is configured in a secure manner. A Member may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Member may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner.
m. Long Connections and Multiple Logins. Using a personal dial-up account for high volume or commercial use is prohibited. The Services are intended for periodic, active use of email, newsgroups, file transfers, Internet chat, games, and browsing the World Wide Web. Dial-up members may stay connected so long as they are actively using that connection for the above purposes. Members may not use the Services on a standby or inactive basis in order to maintain a connection. Pinging is expressly prohibited. Accordingly, Wonderwave.net maintains the right to terminate any member’s connection following any extended period of inactivity as determined by Wonderwave.net.
3. REPORTING VIOLATIONS OF Wonderwave.net'S AUP
Wonderwave.net requests that anyone who believes that there is a violation of this AUP direct the information to Director-Abuse Department, at: abuse@WonderWave.net
If available, please provide the following information:
- The IP address used to commit the alleged violation
Email with full header information provides all of the above, as do syslog files. Other situations will require different methods of providing the above information.
Wonderwave.net may take any one or more of the following actions in response to complaints:
- issue written or verbal warnings
REVISIONS TO THIS ACCEPTABLE USE POLICY
Wonderwave.net reserves the right to revise, amend, or modify this AUP, our Internet Service Agreement and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with the Internet Service Agreement.
